Legal notice

This notice identifies the owner of www.pekata.ch and sets out the conditions for accessing and using the site, in compliance with Article 10 of Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI).

2. Purpose

www.pekata.ch is Pekata's catalogue of personalised merchandising for companies. On it you can browse products, see indicative prices and request a quote. Accessing and browsing the site confers the status of user and implies acceptance of this legal notice.

Published prices are shown excluding VAT, refer to the quantity indicated next to each one and include single-colour branding in the product's standard area. For made-to-order products, the price includes the customisation chosen in the configurator. There are two ways to order. If you request a quote, the published prices are indicative: the price that counts is the one in the quote we send you in writing, and the order is only closed once you accept it. If you buy directly on the site with your design already added, the price is the one you see when you confirm the purchase, with shipping and taxes broken down, and the order remains pending until we review the design, normally within one working day. For card payments, we only place a hold for the amount and charge it when we approve it; if we cannot approve it, we release the hold without any charge and let you know. For bank transfer, production starts when we receive the payment. On orders of €500 or more, including VAT and shipping, you can pay by bank transfer or by card; card payments carry a 1.5% surcharge on the taxable amount, plus any applicable VAT. If you buy as a private individual, without a company or VAT number, card payments carry no surcharge. Each quote also has a minimum order value of CHF 91.80 excluding VAT in products, not counting shipping.

All orders are paid for before production: we do not offer deferred payment. The delivery time for each product is indicative and starts from when we receive payment with the approved design; we strive to meet it, but a delay by the carrier or due to circumstances beyond our control does not entitle you to cancel the order or to compensation.

3. Intellectual and industrial property

The contents of this site (texts, design, code, Pekata's logos and trade marks) are owned by Reloting, S.L. Product photographs and descriptions belong to Reloting, S.L. or to the manufacturers and suppliers who have authorised their use, and the product brands that appear in the catalogue belong to their respective owners. The reproduction, distribution, public communication or transformation of these contents without express authorisation is prohibited, except for personal and private use.

Lifestyle photographs are digital recreations, and the mock-ups with your logo are an indicative representation of the result: the final colour, size and position of the branding are confirmed in the quote.

The logos and other graphic elements you send us remain yours. By sending them you declare that you have the right to use them and you authorise us to reproduce them solely to prepare the mock-up, the quote and, if you accept it, the order.

4. Conditions of use

You undertake to make lawful use of the site, not to use it for activities contrary to the law, good faith or public order, to provide truthful information when you request a quote and not to introduce into the network any programs or data that could damage the systems of the owner or of third parties.

5. Links

This site contains links to Pekata's corporate website (www.pekata.es) and to our social media profiles, as well as to third-party sites. Reloting, S.L. is not responsible for the contents or the policies of third-party sites, visits to which are governed by their own terms.

6. Liability

Reloting, S.L. endeavours to ensure that the information published is accurate and up to date, but does not guarantee the absence of errors or the uninterrupted availability of the site, and shall not be liable for damages arising from causes beyond its reasonable control. The availability of a product and its delivery time are confirmed in the quote.

7. Data protection and cookies

The processing of the personal data we collect through this site is governed by the Privacy policy and the Cookie policy.

8. Returns and claims

Our products are made or branded to order with the customer's logo or design. For that reason, once the quote has been accepted or the purchase made, no returns or exchanges are accepted for withdrawal, for an ordering mistake by the customer or for a change of mind. If you buy as a private individual, you do not have a right of withdrawal either: Spanish law excludes it for goods made to the consumer's specifications or clearly personalised (article 103(c) of the consolidated text of the General Law for the Defence of Consumers and Users, Royal Legislative Decree 1/2007). Anything that arrives damaged, defective or different from what was approved is replaced free of charge, as explained below, and as a consumer you also keep the statutory guarantee of conformity.

  • Claims: if the goods arrive damaged, with a manufacturing defect, or with a print that is faulty or differs from the approved mock-up, write to us at [email protected] within 7 calendar days of delivery, with photographs, and keep the goods. Visible transport damage must also be noted on the carrier's delivery note on receipt.
  • Hidden defects: a manufacturing defect that could not be noticed upon receiving the goods can be claimed within 30 calendar days of delivery, with photographs.
  • Remedy: we replace or re-print the affected units free of charge and, where that is not possible, refund them. A claim on part of an order does not affect the rest.
  • Approved mock-up: the position, size, colours and wording of the print that you approved in the mock-up cannot be claimed afterwards.
  • Tolerances: owing to the nature of production, the units delivered may differ by up to 5% from those ordered, and the quantity delivered is invoiced. Slight variations in colour against the Pantone reference or in the position of the print, inherent to the material and the technique, are not considered a defect.
  • Cancellation: you can cancel a paid order at no cost as long as it has not entered production, and we will refund you the full amount. Once in production, it cannot be cancelled. For custom-made products, if you do not approve the manufacturer's mock-up, we will cancel the order and refund you the amount.

9. Samples

You can order samples of the products in the catalogue to see them before placing your order. They are governed by these conditions:

  • Businesses and professionals only: samples are sold to businesses and professionals buying for their activity, who declare this when ordering them and give their VAT number. For that reason the consumer right of withdrawal does not apply.
  • Price and payment: they are paid in advance by card, through our payment provider Stripe, at the price shown when ordering them, plus shipping and the applicable VAT. They are always charged in euros; if the site shows another currency, that amount is for guidance only.
  • When they are charged: when you pay, the amount is authorised on your card. Unbranded samples are charged straight away; if any carries your logo, the charge is made when we send it into production. If a sample cannot be made, it is not charged and that part of the authorisation is released.
  • Deduction from the order: if you then confirm an order from your quote and its products exceed €500 excluding VAT, we deduct from it what you paid for your samples (the samples and their shipping, excluding VAT). Each sample is deducted once only. This does not apply to a direct purchase with your design already added, and the amount of the samples does not count towards the minimum order.
  • Delivery: samples are delivered in the country of the billing address. For another country, or for areas we do not ship to from the website, write to us at [email protected].
  • Limits: there is a maximum number of units per product and a maximum amount per order, shown when you order them.
  • Your quote: samples are linked to your quote. While they are on their way, its order cannot be confirmed and its prices do not expire; once they arrive, you can confirm the order, ask us for changes or not go ahead.
  • Claims: samples cannot be returned. If a sample arrives damaged, with a defect or is not the one you ordered, let us know within 7 calendar days of delivery and we will replace it free of charge or refund its price.
  • Invoice: we issue the invoice for the amount charged and send it to you by e-mail.

10. Applicable law

This legal notice is governed by Spanish law. For any dispute arising from access to or use of the site, the parties shall submit to the courts and tribunals that have jurisdiction under the applicable legislation.

11. Deliveries outside the European Union

Orders delivered to Switzerland, Liechtenstein, Norway, Iceland or the United Kingdom are dispatched from our warehouse in Spain under DAP conditions (Incoterms 2020): we deliver them to the agreed address and you, as the importer, pay the import VAT, any applicable duties and customs clearance. Our invoice is issued without Spanish VAT, as an export, with the tax identifier you provide as the importer.

Customs clearance adds a few days to the delivery time. Outside the European Union, we do not sell food or alcoholic beverages.
